Judge says tenant can't be kicked out by building owner PITTSBURGH - A Washington woman and those she represents can't be kicked out of apartments at the George Washington before a trial, according to a federal court judge's decision Wednesday. However, Judge J.D. Cohill didn't give that same protection to a man living at the former hotel on Main Street in Washington who says he has a service dog. Cohill ruled that an injunction is appropriate for Kathleen Kleinmann and Tri-County Patriots for Independent Living because they established that there would be irreparable harm if they were evicted. He ruled that Robert Milan was unable to establish irreparable harm because he hasn't lived in an apartment in the building long or invested in changes at the apartment. Kleinmann and Milan filed the lawsuit alleging disability discrimination in federal court on March 3. The case was placed in the court's Alternative Dispute Resolution Program. Milan claims the George Washington wants to evict him because he has a service dog. The George Washington's management says it wants him out because he didn't get a credit check or pay rent. District Judge J. Albert Spence threw the eviction out of court, allowing Milan to remain in the apartment. The George Washington appealed that decision to Common Pleas Court.
The George Washington tried to evict Kleinmann after saying she had a friend stay with her for more than five days without management's permission, which is a violation of her lease. She said the management is discriminating against her and TRIPIL, an organization that works to help those leaving nursing homes find a place to stay.
