Jury: Greene driver guilty

WAYNESBURG - It took a Greene County jury just about three hours Wednesday to convict a 20-year-old Waynesburg woman of vehicular homicide and manslaughter in connection with the March 13, 2007, traffic death of Hope Maley.

Britnee Moore of 135 W. Lincoln St., standing beside her attorney, showed no emotion when the verdicts were read shortly after 2 p.m., perhaps in response to an admonition given minutes earlier by Judge William Nalitz.

Nalitz said there were people in the courtroom who loved Hope Maley, and there were people who loved Britnee Moore, and there were people who perhaps loved both of them. "But there will be no outbursts," he said.

"This courtroom is a place of reason and decorum and not a place for emotion," Nalitz said.

The courtroom might not have been a place for emotion, but the jury deliberation room certainly was.

One juror, who did not want to be identified, said the whole experience "was gut-wrenching."

The juror said there was some initial debate about the element of reckless endangerment, one of the three charges of which Moore was convicted.

"There was really no debate about guilt; we all agreed she was guilty of something," the juror said.

But what convinced the jury to convict Moore was the evidence that the defendant crossed the center line, was reaching for her cell phone and was driving at a high speed, "elements that caused the death of Hope Maley."

The juror also said once the decisions were reached on the verdicts, "there wasn't a dry eye in the room."

Moore was accused of driving at a high speed on Route 218. While allegedly reaching for a cell phone, she crossed the center line and slammed head-on into a car driven by Maley, 16.

"The verdict sends a message to pay attention to the road," said District Attorney Marjorie Fox, who prosecuted the case.

"If not for the actions of Britnee Moore, both families would have been spared this. What this case demonstrates is what can occur when the rules of the road are not followed or obeyed," she said.

Mike Bigley, Moore's attorney, said he respects the verdict of the jury but was disappointed it did not see the defense's theory. He did not elaborate.

Bigley was asked how Moore was holding up after the verdict, and he said, "I think she has taken responsibility for the actions the jury held her accountable for, and I hope this can be the beginning of a healing process."

Meanwhile, Darlene Maley, mother of the victim, said, "I just want people to know Hope's life matters, and we were praying for justice. The jury saw the truth, and I am praying for all the truth to be revealed."

Nalitz continued Moore's $25,000 percentage bond, and he instructed the county's adult probation office to prepare a pre-sentence report to be completed in 30 days.

This woman didn't set out to do harm that fateful day. She did something stupid, so her punishment should be her doing something stupid again, such as cleaning the toilets in the courthouse, or the restrooms on the interstate.

I hope that all can see that this is the best thing that could've happened in this case. Sometimes lifes toughest lessons are lessons learned. Prayers have been answered here and my heart goes out to all involved. Justice was served. I went through the same type of event and I am thankful that I had been punished for my actions or I would not be the person I am today...a better person. Thank you.

That is purely what it was. A complete total tragic accident. All of us do it and yet what if we were in her shoes? We would hope mercy would be granted for us and we would be allowed to talk to others and share our story to those who are young drivers. The girl is attending college for nursing and yet now that is being taken away from her. Really what is jail going to do? Besides take away something she is working hard to pursue right now. Nothing will bring hope back. For all of you who have bad mouthed Britnee have respect for she now has to deal with yet another devastating change in her life. Next time you go to answer the phone call remember you may think that it is harmless but you to could be going to jail over an accident. Britnee keep your head high, so many people are supporting you.

The question of why can be asked a million times. Why did Hope have to die? Why was Britnee speeding? Why did she reach for the phone? Why didn't Britnee observe the posted speed limit? Etc. and the list goes on and on. I do believe Miss Moore will never forget the fact she took a life with her actions. Is that punishment enough? Many feel this covers it. She is guilty, has been through a living hell so it's time to let her go. Well, guess what people, it doesn't quite work like that. Let's get down to brass tacks, she faces a maximum of 7 years. She will be 27 if, and that is a big IF, she receives the maximum punishment. As I have posted before, she has a lot of life to live after the jail time. A lot of life Hope Maley and her family will never experience. Children, grandchildren, graduations, weddings. etc. The argument that everyone has broken the law at one point or another is moot. Britnee was not on trial for ME breaking the law, she was convicted FOR HER ACTIONS. Bringing religion into the argument is ridiculous. For those who believe, you also know that Jesus said in Matthew chapter 22 verse 21: "Render unto Caesar the things which are Caesar’s, and unto God the things that are God’s" The punishment that will ultimately be imposed by the court is "Ceasar's Due" and Britnee will answer to the higher power in which she believes.

I agree that there should definitely be a punishment for this young girls actions. It seems today that we are a society that trys to get our children off the hook and dont allow them to deal with consequences of their actions. But my heart also griefs for Britney and her family. There by the grace of God go I. We all have done it, talked on the phone, drove too fast, been distracted. But I would hope that if I were ever in a similar situation, where my child or myself, I would be willing to accept the punishment or be willing to forgive, and to move on with a more positive future.

This girl does not deserve jail time. She does deserve a punishment but certainly not jail time. I wonder if this would be different if it were a 40 yr old reaching for their coffee or changing the radio. Britnee Moore going to jail will not bring back Hope, and it will not cause a cell phone ban (call your politicians for that). It was an accident and her actions were careless but not intentional. She has to live with this the rest of her life. So let her be around other young people (and others in general) now so she can encourage and remind them to drive without distractions.

I sat in the courtroom all 3 days and there is more to this story than speed, texting along with cellphone use. A lot of other evidence was not presented to the jury. This girl was traveling so fast down that road her vehicle was like a bullet aimed at the Maley girl's car. I could see if she went over the center line a little but her whole vehicle crossed over in to the Maley girl's lane. The impact was so hard that it severely damaged the Maley girl's spleen, heart, lungs, crushing her rib cage and liver. The Maley girls' front end was pushed into the car in excess of 4 and a half feet pushing it backwards. The force of the Moore girl's car even spun her around. She needed to stand accountable for her actions. This by no means was an accident. If you follow the rules of the road and you hit something that is an accident. She broke the rules of the road. She broke the law. She was found guilty by 12 people of ALL 3 counts. She and her family need to accept the verdict. Hope Maley's family lives with their loss every day.

Yes, ellipses, I suppose you have the right idea, but that's not how it works. What about when the McConnell boy killed his sister speeding while driving a car unlicensed in Graysville? Or what about the Ross girl that was driving when the Brozovich girl died? Where was Marjorie Fox then? Because no charges were filed against either of those drivers. NONE! It was like they had done nothing wrong. And what ever happened to the person who wrecked Nancy and Bill Davis on the interstate? Weren't ALL those people negligent in causing someone else's death? Why was NOTHING done to them, but yet Britnee Moore is convicted and faces jail time? Why is it not all the same? It seems like that Hope Maley's mom wanted blood, and it looks like that's what she's going to get, but it isn't going to bring her daughter back unfortunately. This wasn't something that was done maliciously. How many people can say that they have NEVER broken the speed limit? And one time is all it takes. How many can say that they have NEVER been distracted while driving? Thinking about other things, talking to someone, eating, drinking, trying to quiet a crying baby in the back seat, etc. Once again, at the wrong time, once is all it takes. It could happen to many of us. I don't think jail time is the answer for Britnee Moore. Community service would serve both her and Hope Maley's memory better than jail. Speaking at high schools (and not just for a year or two) would convey a message to many young drivers who think nothing could happen to them. My heart aches for all involved, it's a tragic situation for them all.

Well said courtroom observer! I agree, she broke the law. She deserves what she gets. She STILL has a lot of her life to live while the Maley girl doesn't, as another poster said. No one deserves to "get off the hook" for these kind of actions. I'm not trying to be mean but look, she still has her life & family & the Maley girl's life is lost. Doesn't seem fair to me is all. Yes I have children & I hope & pray nothing like this would ever happen. It's a sad situation.

Our state lawmakers had a chance recently to approve a ban on use of hand-held cell phones by drivers, and they failed to pass the measure. Why? Probably pressure from lobbyists. Because, of course, lobbyists are more important than you and I.

I don't believe anyone checked Hope's phone. Everyone was to interested in Britnee's phone. Also, Hope's mother has had a few traffic tickets in her life, does that make it attempted vehicular homocide? I would hope not.

I'm sure the experts checked both girls phones! They aren't idiots. Hope's blood tests were available, why not Britnee's? Hope's phone records showed nothing at that time. That is why Britnee was charged, her's did. No blood tests for Britnee came to light though, did they??? Britnee got off easy! Probably won't be punished anyway. Her and her family have their noses in the air all the time and will continue to do so. They think they are above the law and probably are. If they are so religious they should feel so bad for Darlene, but yet no remorse shown by any of them. By the way, God hates religion. Jesus is the only way! They should esteem others better than themselves in stead of snubbing everyone who doesn't measure up to their so called, "Highest Standards". People would be more compassionate towards Britnee if she and her family didn't think they were better than everyone else.

Why is it that Britnee Moore NEVER testefied ?? I am not understanding that. How come she did not get on the stand and tell HER side of story ? Is it because she lied the first time when she spoke with police ? Or does she not remember ? And how come they never discussed her BLOOD ALCOHOL & DRUG test levelsif she had them ? I also wonder if they recieved any inofrmation about Hope Maley's cell phone, was she on hers etc ? Where's those reports ? I really believe this was a HORRIFIC TRAGIC ACCIDENT, however, I do think she needs to pay for her negligence that caused the accident. I feel for both families involved, for both their losses. What I DO KNOW is that each and EVERYONE of us will now watch what we are doing while driving more so than what we had already. It's not just you , you have to worry about, it's the other driver, and this story goes to show that. On a side note, someone has told me that there is NO CELL PHONE service in that area ??? Is that true ??????? I feel that those of us that where not at the hearing and didn't see/hear everything will ever know everything about it. So we really don't have a right to judge character either. We all make mistakes. We all learn from them. However, breaking the law & making a mistake = taking a life is different. At least she was held accountable for her actions like ANY of us would if WE were the ones behind Britnee Moore's wheel at that time. I have also been on a jury before, and Marjorie Fox is a PISTOL . I also feel for the jurors who had to "live" this vision of this wreck, it will effect them for the rest of their lives even though they didn't even know the girls or their families. But thank you for your service. I am shocked that they were not even allowed to tear up or weep after the verdict. I do hope the best for Britnee Moore in her life, but I also send my condolences to the Maley family.

Yes, it was mentioned numerous times during the course of the trial, in the courtroom by both the DA and the Public Defender Mike Bigley who defended Britnee Moore that evidence showed Ms. Maley did nothing wrong. It was also mentioned that Ms. Maley's speed was not a factor as she was not speeding. Miss Maley's phone records were brought in at the Preliminary hearing and she was NOT on her cell phone at the time of the accident. I am commenting on what I observed and heard at the trial. It appeared to me that Miss Moore's ex boyfriend was caught in a lie when he took the stand. He testified about not seeing Miss Moore use her phone while he was with her then the DA presented numerous text and phone messages from the Verizon phone records that the police supplied and Verizon confirmed. She appeared to have used her phone around if not more than 20 times during the course of the evening while with him prior to the crash. This information was brought into evidence before he was called in to testify. He then said something like, yeah I guess she did and that's what it shows. Phone records even showed that he even called her to see if her phone was working which it was. Months after the crash Miss Moore apparently sent some form of an e-mail to another friend letting him know that she thought his ex girlfriend ( Miss Martin )was a snitch as she came forward and told the police what she knew. That girl took the stand and testified that Miss Moore admitted to her and another girl that the accident happened when she was reaching for her phone. It appeared that Miss Moore then blamed her friend at that time, Miss Martin for causing her to have the accident. I think Miss Moore needs to stop blaming other people for her actions and take responsibility for them. Reaching for her phone was her choice nobody else's. I hope this answers your question.

While it is true Britnee Moore did not take the stand. That is one of her Constitutional rights. She is presumed innocent until proven guilty. She does not have to prove her innocence as explained by Judge Nalitz. Apparently that was her choice and no one has the right to make her take the stand. I am not sure why the toxicology results were not mentioned in this case. I believe and it is to my understanding since she was not charged with DUI they were not allowed to be entered. It has been released that Hope Maley's drug and alcohol results were negative. Hope Maley was not on her phone at the time of the accident. Evidence for that was presented at the Preliminary hearing. Also to my understanding, Hope Maley was not speeding as determined by both experts Sgt. D'Andrea and Dr. Eck and was on her side of the road. Miss Moore was totally on Hope Maley's side of the road. The way I perceived it was that Miss Moore was traveling so fast that Miss Maley at the speed she was traveling between approx. 42 - 47 mph ( determined at the Preliminary hearing ) had no time to react to the vehicle barreling at her which as the DA put it blew her off the road.

Several years ago a young woman and her friend were coming off the interstate ramp on 519 in her father's SUV and cut right in front of my small Geo. I remember a man stopping to ask me if I was alright and the look on his face made me think he thought I might be dead. The girl continued to say it was an accident and of course she had a cell phone in her hand to call the police. Later it was discovered that she not only did not yield, but did not stop at the stop sign. Due to her negligience I was off work and unable to walk without support for quite a while. I'm sure she was too busy talking to her friend or on the phone when she neglected to see the signs. In her mind this will always be an "accident" but I know it was total disregard for the rules of the road. She was lucky and I was lucky the accident wasn't work. But then, to her, it would have always been an accident, to me, it would have been my life.

Oh please, no vendetta, you do wrong you need to stand accountable. The DA and police are just doing their job. The jury did their job. It is not personal, it's the law and the law was broken. A young woman died in a horrific crash. Her life had value and was priceless. All of our lives are priceless that's why we all need to take care. The DA, the Judge, the Police as well as the jury had a job to do and they did it. No vendetta.

I think the lesson we all can take from this is. USE YOUR BLUETOOTH OR DON'T USE UR PHONE AND DRIVE DUMMY. bluetooth is 20 dollars. now. spend 20 bucks or 20 years in jail. and if that girls only gets 7 years it's a shame and a scam.

Whose to say charges will not be brought in these other accidents? It is possible that the statute of limitations may not have expired on those cases. It has been less than a year since the Brosovish / Ross accident. It took well over a year for Brittnee to be charged.

This is really crazy. We can't point fingers and say "this should happen" or "that isn't right" ... We live in the U.S. of A. We have laws, rules, regulations, etc. If we don't agree with them, we need to take a stand to change them. Ms. Moore made a terrible mistake, for which she is terribly sorry. She has not and will not get off unpunished. The Moore family and the Maley family along with friends of all, will relive this entire ordeal for the rest of their lives. Ms. Moore will pay the price the court (as by law) sets for her to pay. No matter what that price is, it can never compare to the price she is already paying. I know the jurrors on this case had a terrible task to perform. They talked and cried together. It was not easy for them. They, along with the families, did and will continue to do what they have to do to get beyond this. Thank God we live in a country where we are all free to voice our views and opinions. And, Ms. Moore, I don't know you or your family, but I pray you do well in life. Maley family, I don't know you either... but I pray for you... I can't imagine having to cope with your loss.

How many of us have teens out on the road driving right now?? How many of us have perfect teens out on the road driving right now that never speed, use their phones, change a cd, or tell a lie etc... Don't be so quick to judge it could be your child tomorrow. Sometimes no emotion is shock or medication or depression. I think there's a saying , Until you've walked a mile in someone else's shoes. Ease up people. No one has perfection in their lives. Again it could be your family tomorrow, would you want people judging your childs every emotion and slandering you and your family on the internet??

Such a shame what happened. Britnee needs some friends and some hugs. She should serve jail time. 5.5 years sounds like the right amount. She can learn while in prison and maybe come away with something. She can write a book. Maybe about bears for instance. She will come out a better person from this. She should get a bluetooth headset so she won't have to worry about reaching for her phone. Sometimes tragic events over time can be made positive.

I was a juror, I did not ask to be a juror. I did not know either family before the trial. I did not speak to either family after the trial. We jurors only did what we had to by the law. We did not reach this decision easily. After we did, all 12 of us in the deliberations room cried. We cried for both girls and families. We had to compose ourselves before we could return to the courtroom. Some of us barely did. When you are a juror you are not allowed to have sympathy for either family. Please do not hate or dis-respect the jurors for doing what was required by the law. We were not told what Brittnee's punishment would be. We know both familes have to live with this for the rest of their lives. So do we.

How do you know that these other cases are not still being investigated? The Ross/Brosovish incident took place less than a year ago. It took well over a year for charges to be filed in this case. It is possible there are still charges pending and that the statute of limitations has not expired in those cases.

Jail is not a death sentence. Moore is 20 years old. She will still be in her tweenties even if she gets the max sentence. She still has time to live her life unlike the victim whose life she took. She should go to jail or prison in my opinion. Kdka said seven years is the max.

Did you see Hope Maley's shirt in her picture. It said "Live Your Life". My kids have clothing from American Eagle that say the same thing. How tragic that her car was made her tomb just like Marge Fox said. Fox said something like Moore blew the victim off the road. Dr. Wecht described Hope's injuries. Hope Maley was crushed to death by no fault of her own.


Darlene's motives : 6/4/2009
The only motive Darlene Maley has is justice for her daughter's life and the truth behind what actually happened. She gets no pleasure out of any of this. If she could have it her way she would rather be home with both children watching a movie or making dinner for them. Her children are what matters to her, they are her life and now one is gone. Anyone who truly knows Darlene knows this to be fact. She loves her children more than life itself. Hope's death has devastated her more than anyone could imagine. Ty is the only one that keeps her going. Just walking into their home you know this to be true, it is totally dedicated to them. She is a kind, wonderful and loving mother through and through anything other than that is just a lie started by bitter and jealous people / outlaws.

She got what she deserved, although she will never do the full time & probably won't learn a cottonpicking thing from it all. Hopes family will never have their girl again, she is gone. The Moore family can visit Britnee behind bars on visiting day. Theres a lot more to this story, evidence not collected, evidence not shown tht would still have sent the Moore girl to prison where she belongs.NOBODY should be using cell phones while driving. Its a shame there wasn't a law passed to that effect.

Im sorry, but I dont see why you people think that you are important and that your opinions are valid here. Are you trying to feel "included" in the drama by acting like you know whats going on and that what you say is going to change either one of these poor girls fate? There are things called a jury. This trial had one, did their job, and reached a verdict. Whats done is done, no matter the outcome. Get over it and let these people move on with their lives.

I myself have never been on a jury. I was at the trial all 3 days and watched the faces of all the members of the jury. I could tell that all of you took your job seriously even the alternates. Some of you looked like you had the weight of the world on your shoulders. You did have a duty to perform and that duty was to listen to the evidence presented to you and eventually come to a unanimous decision. By your faces, I could tell that it was not an easy task for any of you. I for one commend you for your service. No one should ever hold the decision you as a jury made against you and you should not feel any guilt for that decision. Our court system has laws in place and it is your lawful duty to abide by those laws. You did not make the laws, you just followed the guidelines from which those laws were made. When you asked again for the definition of the laws for which you were making your decision I knew you wanted to make absolutely sure you were making the correct decision. Thank you again for your time and your service to our County.

This girl, a murderer is going to probably get a year in jail and thats it. But on the other hand you have the monkey theif who DIDNT kill someone while not paying attention is gonna do a 2 to 5 year sentence for stealing a monkey. judicial system is wack.

Yes, the Ross accident is less than a year old, but the one from Graysville involving the McConnell boy and his sister Daianara Bedilion is over 2 years old. The one involving Bill and Nancy Davis is older than a year also. It just seems that the rules don't apply to everyone. And I don't think that ANYONE on here is claiming that Britnee Moore is innocent or should not be punished. AND may you be fortunate enough to have a teenager who hasn't ever made a poor choice for a boyfriend/girlfriend or ditched a class. AND I didn't realize her parents were on trial too for being stuck up/religious/raising a brat/thinking that they are better than most. What the hay?!?! Am I missing something? I was in front of the courthouse. I saw Janet Mawhinney shouting and waving her finger. I saw her on the news also doing the same thing. No family members were fighting. I only saw Janet Mawhinney trying to upset Hope's family and friends. Janet Mawhinney was taking pictures of Hope's family and friends. It was bizarre. Is Janet Mawhinney related to the Moore's or good friends with them? I did see her sitting with the Moores inside the courthouse.

I was there. How come the judge read all the charges a second time in the afternoon and the jury left and came back within minutes. That was strange.

Yes, I also saw her sitting with the Moore's and before that with Hope's dad. It seemed to me that she was trying to listen in on conversations that were none of her business and taking pictures of Hope's mother when we were talking to her and she was all by herself. Then she was yelling some trash talk at Hope's uncles and the newspaper people. Wow, I think she needs to get a life, what a busy buddy.

Moore was found guilty of more than one crime. I would like to know if a drug test was taken by her. If yes what are the results. If not why on earth not? What exactly was she after in that parking lot of the Uniontown mall? I know that Uniontown is known for having a bad reputation for drugs. Did it have something to do with drugs? Why would she drive all the way there to meet somebody? And not even go into the mall? So many times people facing jail or prison claim to be innocent and claim to find religion. Actions speak louder then words.

It sounds to me all the facts of the case have not been made known yet. But Moore is a convicted criminal. Don't forget a jury of her peers heard all the evidence that was presented. Even without a toxicology report being introduced as evidence for Moore one way or another. She was convicted. The newspaper reported the defendant did not take the stand. Hopefully everything is brought to light very soon and it will help shed some more light on the activities that are reported to have taken place. What is going on with the county tax dollars and the defendant's defense.

The defendant was convicted. Let it rest. Why do you feel the need to continue pressing on? An article in todays Observer reported that Donte Stallworth was convicted on Manslaughter DUI, he got 30 days in jail. The conviction carried a 15 year term in jail. The reason for the 30 days? The victims family wanted the tradgedy behind them.

Yeah, the family wanted it behind them you say. It also stated they reached a confidential financial settlement in order to get that 30 days. In other words in my opinion the bought the family out. Money talked, Stallworth walked. Stallworth is a Cleveland Browns wide receiver. I'm sure he makes a pretty penny. So the way I figure, it must have been a couple of million to make that family want to put things "behind them" so to speak. What value do you put on life? If it were my family member it would be priceless. It also stated that he pleaded guilty to the charges in addition to the 30 days he will have 2 years house arrest and 8 years probation and his driving privileges will be suspended forever. He will also not get paid for a few of the games this year. That's a little different than just the 30 days as you stated.

The jurors deserve our respect.They had to see the pictures and hear the horrific testimony of the death Hope Maley suffered. It would be very hard to see and hear such details. They should be commended. The guilty verdicts they reached also need to be respected.

I commend the District Attorney for getting all three guilty verdicts as well as the State Troopers for all of the time and work that must be involved. I commend the Jurors. Jurors are a very important part to the justice system.

Sentencing is scheduled for Thursday July 30, 2009. The time is 9:OO AM, The location is the Greene County Court House, Waynesburg PA. Open to the public.
