Shooting leads to charges against Franklin Twp. man
Police charged Samuel William Boyd, 63, of 440 Rolling Meadows Road, with two felony counts of aggravated assault and one count each of simple assault and disorderly conduct.
The man Boyd allegedly shot, William Henry Durbin, 39, of 407 Cedar Wood Drive, Carmichaels, also was charged with terroristic threats, criminal trespass, simple assault, disorderly conduct and public drunkenness.
Durbin was taken to Ruby Memorial Hospital, Morgantown, W.Va., for treatment of a gunshot wound to the liver. He is recovering from his injuries, police said.

An argument between the two men turned into a fight. Boyd removed Durbin from his home and Durbin either fell or was pushed from the front porch, injuring his hip and leg, police said.
A witness who had driven Durbin to Boyd's home urged Durbin to leave, but Durbin failed to do so.
Boyd subsequently called 911 twice to ask for police assistance, police said. Two others at the Boyd home also called for police.
Boyd then got a .22-caliber revolver from inside the home and went out on the porch. Durbin grabbed a metal lighthouse ornament from a rock garden near the sidewalk and hit Boyd with it on the arm and wrist before throwing the ornament at Boyd.
As Durbin walked down a sidewalk toward the garage, police said, Boyd shot him in the lower right back. Boyd then called 911 and reported he had shot Durbin in the back.
Police said Boyd later told them he had shot Durbin after Durbin bent over to pick up a rock along the sidewalk that he believed Durbin was going to use to harm him. He also told police he was trying to shoot Durbin in the leg.
Durbin told police he had hit Boyd with the ornament because Boyd had a gun. He also said he was walking toward a vehicle in the driveway to leave when Boyd shot him in the back.
Charges were filed with District Judge Glenn Bates of Franklin Township but were expected to be transferred to another district judge because of a potential conflict.
Shooting a Home Invader : 8/9/2008
This is an example of why we need stronger laws in PA to permit self defense. The legislature has twice had bills before it to expand the "castle doctrine" of self defense but failed to act on them. Another reason for change in the state house. One man comes to another man's home, is drunk, gets into a physical altercation, is ordered to leave and doesnt. Homeowner and family make several calls to 911, but no police show up in time. Home invader grabs something and beats homeowner and then throws it at him, despite being confronted with a loaded gun, indicating home invader is a dangerous maniac who cannot be controlled by any means except deadly force. Homeowner shoots, but only to wound, home invader, and then gets charged. OUTRAGEOUS. Years ago a Greene County DA named Pollack prosecuted in a similar case. After the jury found, unanimously, him to to be not guilty, the DA was promptly voted out and has lost every time he's reared his ugly face to run again. Maybe it's time for a new DA in Greene County. I wish I could sit on that jury. If the rest of them were insane enough to convict (which they probably wont be), I'd hang that jury till the cows came home before I'd vote guilty of anything, even disorderly conduct.
Man Charged in self defense shooting : 8/11/2008
I posted several days ago but as of now, Monday, 5pm, it hasnt been posted- perhaps because the DA in Greene County is the wife of an OR Editor? Once again, the OR is on the side of evil because it's in their editors' interest. The DA should be thrown out of office for charging the homeowner, just like her predecessor, Pollack, was thrown out of office by the voters after a similar case. Your own recount of this episode is as follows: A man comes to another man's home drunk. The intruder, who is a quarter century younger, gets into a physical altercation with the homeowner, who then removes the intruder from the house. Intruder refuses to leave the private property he is on, even after it is made clear to him he is not welcome. Homeowner calls 911, and other family members call 911. The police dont show up for a while and the intruder continues his antics, hitting the homeowner with a metal object twice and then throwing it at him. Belligerent, drunken intruder starts to pick up rock to throw at elderly homeowner. Homeowner has already brandished a firearm in hopes intruder will leave after seeing it, but intruder continued his attack and refused to leave despite seeing the gun. Finally, homeowner shoots intruder, but only aims to wound him, then immediately calls 911 to obtain medical care for intruder he was forced to shoot in order to protect himself and his family. And the OR editor's wife, the DA charges the homeowner. Of course, you wrote the article to indicate the state police charged him, but no one gets prosecuted for a crime without the DA's concurrence. It's wrong, and it's wrong of you people at the OR to refuse to print my comments just because you are connected to the DA down there.
