Police: Brothers stole from dead man

WAYNESBURG - Two men allegedly broke into a dead man's apartment in Waynesburg Wednesday and stole various items before borough police arrested them, along with an alleged conspirator.

Joshua Franklin Davis, 20, and Christopher Warren Davis, 22, both of 141 Second St., Clarksville, were arraigned before District Judge Lee Watson on burglary and other charges and jailed on $30,000 straight bail each.

Another man, Benjamin Franklin Howard II, 42, of 784 E. High St. Suite 1, Waynesburg, allegedly suggested the burglary and provided a place to store the stolen items. He was charged with conspiracy and receiving stolen property and jailed on $50,000 bond.

Police said Howard told the Davis brothers that his neighbor, Roy E. Pyeritz Jr., had died. He also allegedly told them that Pyeritz had a new game system that they should take from his apartment on High Street.

Pyeritz, 24, died Monday.

According to police, Christopher and Joshua Davis used a hammer to break the door lock and entered Pyeritz's apartment about 2:40 p.m. Wednesday. Once inside, they allegedly took a DVD player, an X-Box 360 video game machine, two video games and a controller.

Richard Nicklow of Waynesburg confronted the men as they left the apartment and he called police.

Police said officers found the DVD player during a search of Howard's house. Police arrested the Davis brothers at a different residence nearby. They have allegedly confessed to the burglary.

Joshua and Christopher Davis both face felony charges of burglary and criminal conspiracy and misdemeanor offenses of theft, criminal mischief and receiving stolen property.

Preliminary hearings for all three men have been tentatively scheduled for Wednesday before District Judge Watson in Carmichaels.

All of the stolen property has been recovered and police said it will be returned to Pyeritz's family.
