PUC wants local budgets related to Act 13 impact fees

HARRISBURG – The Pennsylvania Public Utility Commission on Thursday decided that budget reports from local governments receiving Marcellus Shale impact fees will be due March 1 of each year.


For the upcoming year’s deadline, the municipal budget reports for both 2011 and 2012 must be filed with the PUC, the agency noted in a news release.


In subsequent years, only the prior year’s final approved budget report will be due. For example, the municipal budget report for 2013 will be due on or before March 1, 2014.


The PUC also took other action related to Act 13, voting 5-0 that setting conductor pipe constitutes spudding and therefore triggers the impact fee; and that, in case of a transfer of ownership, the producer filing the annual report is responsible for paying the impact fee for unconventional gas wells.


The commission dealt with how impact fees will be assessed to wells that are reclassified from horizontal to vertical, and decided that the impact fee on a plugged well ceases during the calendar year after the well is plugged.
