WAYNESBURG – A Greene County man waived his right to a nonjury trial Monday and pleaded guilty before Judge Farley Toothman.
Floyd Duane Smalley, 48, of 127 Franklin St., Jefferson,was arrested by state police Jan. 27 in Cumberland Township for driving under the influence of alcohol and three summary violations.
Police said Smalley was traveling east on Route 21 in Carmichaels Jan. 27, 2012, when they observed his vehicle travel into the fog lane three times and then cross the double line by roughly one foot. They stopped Smalley after he entered the turning lane near the Carmichaels Sheetz Store, then straddled the white line in the center of the road for approximately 50 feet.
Smalley’s blood-alcohol content was 0.145 percent.
Toothman sentenced Smalley to 48 hours to six months in jail, deferred until Jan. 11. He further ordered that Smalley perform 50 hours of community service in addition to paying fines totaling $735 plus court costs and fees.
