Cal U. basketball player faces new charges

Minutes after one sexual assault case against a California University of Pennsylvania basketball player was withdrawn Wednesday, he again found himself in handcuffs when university police arrested him on rape charges.


Jeremy Posey, 19, of 2540 Holland Ave., Huntingdon, Huntingdon County, is now charged with rape, rape of an unconscious person and sexual assault.


Posey is accused of raping a 19-year-old student inside a room at Residence Hall A on the school’s campus in April 2012.


The woman told police she invited Posey over to her residence to hang out. She told police she made it clear to Posey before he came over that it was not going to be a “booty call” and that nothing sexual was going to happen.


After Posey arrived, the two reportedly talked and watched a movie. The woman told police she fell asleep in her bed wearing her clothing. She was awakened by Posey on top of her back, holding her hands down and engaging in a sex act with her, police said.


The woman told police she was unable to get up. She reportedly told Posey to stop, but he did not reply, but continued.


Posey was taken into custody in Central Court, where he was scheduled to appear for a preliminary hearing before District Judge Valarie Costanzo on charges including rape, involuntary deviate sexual intercourse, reckless endangerment and aggravated indecent assault. He was arrested last month by California police stemming from an alleged assault of a 19-year-old woman at Vulcan Village.


Assistant District Attorney Kristin Clingerman said the original complaint against Posey was withdrawn because given the facts of that case, the commonwealth did not know if there would be a successful prosecution.


Costanzo originally set bond at $50,000. Clingerman agreed to a request by defense counsel Jill Sinatra to set bond at $30,000, the amount set on the original charges. Sinatra said Posey had not been allowed to return to campus. He was in court with his parents sitting in the front row.


Posey was placed in Washington County Jail.


The campus disciplinary process involving Posey is continuing as it would for any student, said Christine Kindl, university spokeswoman. The university is working with law enforcement and prosecuting authorities to address the serious allegations, she added.


A preliminary hearing is set for Wednesday in Central Court on the new charges.
