The man accused of fatally shooting a former Canton Township man in Weirton, W.Va., earlier this month waived his right to a preliminary hearing on the first-degree murder charge and will head to trial.

Adam M. Barnhart waived his hearing before Brooke County Magistrate Robin Snyder Monday morning in Wellsburg and is awaiting trial in circuit court on charges of murder and domestic battery.

Barnhart, 18, of Weirton, is accused of shooting 36-year-old Frank Tulock in the back multiple times after Tulock apparently tried to intervene during a domestic dispute in the West Virginia town in the early hours of Sept. 8.

Weirton police arrested him after officers found him hiding in bushes and weeds, and he was taken to the Northern Regional Jail in Moundsville, W.Va., where he is being held without bond.

Court records indicate Barnhart got into a domestic dispute with another person and Tulock went to the residence in his neighborhood to investigate the problem. He heard Barnhart “yelling racial slurs” while involved in the domestic dispute, investigators said, and responded by stating he has biracial children and didn’t appreciate the comments.

Weirton police said Barnhart went into his Hudson Avenue home and pulled out a .45-caliber handgun before shooting at Tulock eight times while he walked back to his residence nearby. Tulock was hit several times but was able to make it back to his Orchard Street home, where he collapsed and died at the rear of the residence.

Tulock was a 1995 graduate of Trinity Area High School and worked as a mechanic, relatives said. He previously lived in Canton Township before recently moving to Weirton.

Barnhart’s case will now be transferred to West Virginia’s First Judicial Circuit Court. A magisterial court worker said a court date has not yet been scheduled.
