Charges against police officer withdrawn
A police officer with a department in Allegheny County expects to be immediately reinstated to his position after assault charges against him were withdrawn Thursday.
Thomas Calvin Weaver III, 29, of West Alexander, was arrested Sept. 16 by Donegal police after he allegedly grabbed his estranged wife, Jennifer Weaver, by the throat and threw her against her car in the parking lot of Claysville United Presbyterian Church. The two were meeting in the parking lot so she could drop off their children before going to work.
Officer Adam Fichter, who filed the charges of simple assault, terroristic threats and harassment against Weaver, told District Judge Ethan Ward that he was withdrawing the charges at the request ofJennifer Weaver.
She also had the protection-from-abuse order filed against her husband lifted, he added.
“The victim just wants to move forward,” Fichter said.
Ward asked Jennifer Weaver if she had gone to police after the incident. She told Ward that she had, but wanted information on getting a protection-from-abuse order and had not intended on filing charges. Jennifer Weaver also told the judge that she feels sure that nothing will occur in the future, adding that her husband was staying with his parents.
“I don’t like dismissing charges on domestic cases like this,” Ward said. “Situations can get out of control. But I have no choice in this matter but to withdraw the charges.”
Thomas Weaver’s attorney, David Wolf, said both parties resolved the matter amicably. He said Weaver would be reinstated by the Braddock Hills police department effective immediately. He had been suspended after his arrest.
