Fayette DA withdraws homicide charge against Uniontown man
A man charged in a fatal shooting in a Uniontown bar that left two people dead will serve five to 10 years in prison after the district attorney’s office withdrew a homicide charge.
On Wednesday Daryl Maurice Truley, 33, of Uniontown, pleaded guilty to a felony charge of prohibited possession of a firearm. In a separate case, he pleaded guilty to a charge of possession of a controlled substance with intent to distribute. He received concurrent five to 10 year sentences for both charges.
In an emailed statement, District Attorney Michael Aubele said after reviewing evidence and witness statements he believes Truley was acting in justifiable self-defense when he shot and killed Darroll Gregg, 32, of Uniontown.
“I came to the conclusion that we would not be able to sustain our burden to demonstrate that a criminal homicide had been committed,” Aubele said. “(Gregg), the alleged victim, was clearly the first aggressor; he displayed a firearm and came after Mr. Truley, assaulting a known female in the process. Mr. Truley had no reasonable opportunity to retreat.”
The shooting occurred on March 8, 2023 at the Sail’s Inn bar on North Gallatin Avenue. Also killed in the shooting was 28-year-old Tommy Stargell Jr. Truley was never charged for Stargell’s death. Aubele said investigators were not able to determine who was responsible for killing Stargell.
“It was apparent from the video that Mr. Stargell was attempting to come to Mr. Truley’s aid. Further, in speaking to Mr. Stargell’s family, I determined that he and Mr. Truley were close friends with no ill will toward one another,” Aubele said.
Truley was represented in court by Greensburg attorney Brian Aston. Aston declined to comment on the case beyond providing the details of the plea agreement.
“Through this plea agreement, Mr. Truley was able to assert his right to defend himself while accepting responsibility for his illegal possession of a firearm,” Aubele said.
