No felony conviction in concert rumble

A Washington County jury deliberated a little more than two hours Wednesday afternoon before finding an Aliquippa man guilty of reckles endangerment and simple assault of a teenager whose fingertip was bitten off last June during a concert at First Niagara Pavilion, Hanover Township.

The jury found there was not enough evidence to convict the victim’s ex-boyfriend, Zachary Nicholas Leone, 22, of a felony count, aggravated assault, which includes a provision for permanent disfigurement.

The victim, Allison Domitrovich, a senior at Hopewell High School, said she was defending herself from Leone, who charged at her date during a Lady Antebellum concert last June as they were walking up the amphitheater’s sloped lawn on their way to the restrooms.

A companion testified Wednesday he warned Leone when he saw Domitrovich and her date, Nolan Harmotto, also of Beaver County, walking nearby. Contrary to what Domitrovich had testified Tuesday, he said Harmotto threw the first punch at Leone.

Domitrovich said she tried to separate the two men in what became a chaotic scene.

Emily Kretz, who filed a report for Landmark Security at the pavilion, testified she interviewed Domitrovich, who was crying hysterically and was in pain, but that the teen did not identify who had amputated her fingertip. She was taken to Weirton (W.Va.) Medical Center and, later, Allegheny General Hospital.

Leone, a supervisor for a landscaping company, faces sentencing by Judge Katherine B. Emery.
