Carmichaels man in ARD program
David M. Lemasters, 39, of 405 W. South St., Carmichaels, was admitted to the Accelerated Rehabilitative Disposition program Wednesday by Judge William Nalitz.
Lemasters was arrested April 6 by Cumberland Township police officer Garrett Toothman, who said he began to follow Lemasters when he failed to use a turn signal and then made a partial stop while rounding a turn. According to Toothman, Lemasters would speed up and slow down and did not come to a complete stop at two stop signs on W. South Street before turning into his driveway.
He was charged with driving under the influence of alcohol, DUI incapable of safe driving and two summary traffic violations. Lemaster’s blood-alcohol content was 0.162 percent.
He received a 60-day driver’s license suspension and is required to complete 90-hours of community service.
Under the ARD program, Lemasters must serve at least one year of probation and pay all fines and costs. He is required to refrain from the use or possession of alcohol. Upon successful completion of the program, he can petition the court to have his record expunged.
