N. Franklin lawsuit withdrawn

A North Franklin Township supervisor Tuesday withdrew a lawsuit he filed in Washington County Court seeking an injunction to remove a fellow supervisor from office.

The suit filed by Silvio Passalacqua against James Huff was dropped after discussions with Washington County District Attorney Gene Vittone revealed there was nothing criminal in the way Huff resigned from office last month, only to later change his mind, said Passalacqua’s attorney, William A. Johnson of Washington.

Washington County President Judge Debbie O’Dell Seneca told Passalacqua Dec. 16 to consult with Vittone or the state attorney general’s office before continuing with the lawsuit.

He sought the injunction after Huff resigned Dec. 17 and later decided to wait at least another month before leaving office. He has refused to discuss the matter at recent board meetings.
