Homeowner sues Smith Township over water damage

Randy W. Thomas of 126 Florence Ave., Burgettstown, is seeking a jury trial and damages from Smith Township over a storm water drainage system installed on a hillside above his home, which he claims has been damaged by water.

Smith Township had its drainage system built in March 2004, Thomas said in his complaint filed in Washington County Court. He said it has an inlet almost directly across Florence Avenue from his home, where water began to flow after it was installed. He contacted the township, but Smith denied there was a problem with the system, Thomas alleged.

Last year, he hired an engineer to find the cause of his water problems, and the engineer concluded they were due to improper installation of the storm water drain.

Smith said the water incursion has damaged the walls, driveway and foundation of his home, plus the basement and property. He is seeking damages in excess of $50,000.
