Man sentenced in assault of child
WAYNESBURG – Joseph Gary Malach, 67, of 82 Greene St., Clarksville, was sentenced Tuesday to five years’ probation for simple assault, indecent exposure and corruption of a minor. A charge of indecent assault was withdrawn. Malach pleaded guilty to the charges before Judge William Nalitz.
Police said Malach inappropriately touched and exposed himself to a young girl over a two-year period, starting when she was 6 years old.
The victim, now 9, told police Malach had touched her, exposed himself to her and showed her pornography while the two were together in his home. Police said the girl also told them of a time when Malach showed her a video on his computer of teenagers exposing themselves and said to keep it a secret or he would be arrested.
According to an affidavit filed with the court, Malach admitted to police touching the child inappropriately and watching pornography on his computer while she was present. Police said Malach told them he knew what he did was wrong but could not provide an explanation for his actions.
As part of his sentencing, Malach was ordered to have no contact with the girl or any of her immediate family members. A special condition of the sentencing also requires Malach to move from the residence within 60 days. He was ordered to pay all court costs, fees and fines as well as undergo a psychological evaluation.
