Holbrook residents involved in May fatal crash given ARD

WAYNESBURG – Two drivers involved in a crash on Route 21 near Graysville that took the life of a motorcyclist were entered into the Accelerated Rehabilitative Disposition program Tuesday by Greene County Judge Farley Toothman.

Adam J. Pettit, 21, and Stephanie L. Merritt, 23, both of Holbrook, were charged with recklessly endangering another person and careless driving, unintentional death following the May 28, 2012, crash that took the life of Jason Mowry, 36, of Mt. Gilead, Ohio.

Pettit also was charged with a stop sign violation and Merritt was charged with disregarding traffic lanes and driving at a safe speed.

Police said Pettit had pulled out onto Route 21 from Grange Road. His sport utility vehicle pulled in front of Merritt’s car, which was traveling east on Route 21.

Attempting to travel around Pettit’s vehicle, Merritt pulled into the westbound lane, where her car collided with Mowry’s motorcycle. Police said the motorcycle struck the left side door of the Merritt’s car, which caused Mowry to strike a utility pole.

Under the ARD program, participants must serve at least one year probation and pay all fines and costs. Those charged with driving under the influence of alcohol also may have their driving privileges suspended and be required to refrain from the use or possession of alcohol.

Those who successfully complete the program can petition the court to have their criminal records expunged.

Others entered into the ARD program Tuesday included:

Donald Louis Hearn, 65, of 249 Bonar Ave., Waynesburg, charged with DUI; arrested May 30, after his vehicle hit a car in the Eagles parking lot, Hearn had a blood-alcohol content of 0.155 percent.

Anthony M. Smotzer, 26, of 155 Maiden St., Waynesburg, charged with DUI and a summary traffic violation; arrested May 21, Smotzer had a BAC of 0.197 percent.

Carolyn S. Yoders, 44, of 140 Bliss Ave., Nemacolin, charged with delivering a controlled substance and possession of a controlled substance; Jan. 8 and Jan. 10, Yoders sold marijuana to a confidential informant working with the drug task force.

Megan Marie Radvansky, 25, of 125 Nemacolin Road, Carmichaels, charged with DUI and six summary traffic violations; arrested May 3, Radvansky had a BAC of 0.254 percent.

James D. Simms, 52, of 229 Palmer Road, Aleppo, charged with simple assault, terroristic threats, harassment and four summary traffic violations related to driving a utility terrain vehicle; May 15, Simms threatened to kill Don Strait and sprayed him in the face with pepper spray, police said.

Teria Lynn Hughes, 30, of 3101 Dorsey Lane, Morgantown, W.Va., charged with DUI and a summary traffic violation; arrested March 24, Hughes had a BAC of 0.162 percent.

Bradley Michael Phillips, 24, of Route 21 Mobile Home Park, Carmichaels, charged with DUI and four summary traffic violations; arrested May 12, Phillips had a BAC of 0.146 percent.

Susanne Marie Harden, 21, of 123 Parkview Knoll, Carmichaels, charged with driving under the influence of a controlled substance and a summary traffic violation; arrested Feb. 27, blood tests indicated she had been smoking marijuana.

William Everly Jr., 47, of 677 S. Eighty Eight Road, Carmichaels, charged with indecent assault, indecent exposure and harassment; employed at Golden Living Nursing Home, Everly grabbed a co-workers breast on March 29, and exposed himself to her on April 2, police said.

Keith Neroni, 36, of 137 Bayard Ave., Rices Landing, charged with DUI; arrested Dec. 16 following a two-vehicle crash, Neroni had a BAC of 0.146 percent.

Gregory F. Peccon, 66, of 304 W. South St., Carmichaels, charged with DUI and two summary traffic violations; arrested Feb. 12, Peccon had a BAC of 0.220 percent.

Zachary Andrew Scott, 19, of 377 Maranda Run Road, Graysville, charged with DUI and a summary violation; arrested March 30, Scott had a BAC of 0.154 percent.

Joseph Carl Bolton II, 40, of Route 3, Lost Creek, W.Va., charged with DUI and three summary traffic violations; arrested April 10, Bolton had a BAC of 0.118 percent.
