Several admitted to ARD program

WAYNESBURG – Nine criminal defendants were entered into the Accelerated Rehabilitative Disposition program Monday by Greene County Judge Farley Toothman.

Those accepted into the program must serve at least one year probation and pay all fines and costs. Defendants charged with driving under the influence of alcohol also may have their driving privileges suspended and are required to refrain from the use or possession of alcohol.

Those who successfully complete the program can petition the court to have their criminal records expunged. Those entered into the program were:

Aniceto Gallegos, 24, of 433 S. Eighty Eight Road, Carmichaels, charged with driving under the influence of alcohol and two summary traffic violations; arrested July 12, Gallegos had a blood-alcohol content of 0.120 percent. His license was suspended for 30 days and he was fined $50.

Donald Joseph Throckmorton, 52, of 564 Old Waynesburg Road, Carmichaels, charged with operating a watercraft under the influence of alcohol; his pontoon boat was stopped by boat commission officers on the Monongahela River July 5 for having an inoperable light; his BAC was 0.084 percent; he was fined $300; his boat license was suspended for 180 days.

Cody A. Reed, 29, of 53 S. Richhill St., Waynesburg, charged with simple assault and harassment; on June 23, Reed repeatedly punched his wife, Elizabeth Tustin, and struck Joshua Hysell in the head with a ceramic bowl.

Grant Michael McCarty, 22, of 125 Eagle Point Estates, New Eagle, charged with DUI; arrested April 18, he had a BAC of 0.113 percent; his license was suspended for 30 days; no fine.

Gary Joseph Bucci, 58, of 229 Shrivers Hill Road, Waynesburg, charged with DUI and five summary violations; arrested March 1, while operating an all-terrain vehicle, he had a BAC of 0.094 percent; he was fined $125; no license suspension.

Larry Benjamin Haywood, 63, of 101 Wilson Ave., Rices Landing, charged with DUI and five summary violations; arrested March 3, he had a BAC of 0.178 percent; he was fined $141; his license was suspended for 60 days.

Brian Lavins, 18, of 171 March Ave., Nemacolin, charged with corruption of minors; on May 3, he gave a tattoo to a juvenile without the consent of the juvenile’s parent.

Michael Jason Law, 30, of 11440 Dayville Road, Frederick, Md., charged with DUI and one summary violation; arrested April 26, he had a BAC of 0.108 percent; he was fined $25; his license was suspended for 30 days.

Daniel Andrew Barnett, 20, of 717 Fort Martin Road, Maidsville, W.Va., charged with DUI and four summary violations; arrested May 24 after he crashed his vehicle on Taylortown Road; Barnett had a BAC of 0.159 percent; he received a 90-day license suspension; $60 fine and was ordered to pay $4,675.66 in restitution for damage to property and to a West Penn Power utility pole.
