Carmichaels man sentenced on drug charge
WAYNESBURG – A Carmichaels man who pleaded guilty in July to possession with intent to deliver a controlled substance and conspiracy was sentenced Dec. 4 by Judge Farley Toothman to two years in the state intermediate punishment program.
Cody Allen Kuntz, 21, of 54 Cumberland Village, was arrested June 4, after he and another man attempted to sell Subutex to an undercover officer with the Cumberland Township Police Department.
The state Department of Corrections earlier determined Kuntz was eligible for the intermediate punishment program, which includes at least seven months in prison, followed by placement in an institutional treatment program and then community-based and outpatient treatment programs.
Kuntz also was ordered to serve a consecutive sentence of 30 months of probation and pay a $500 fine. He had pleaded guilty to the charges July 21.
In another case before the court Dec. 4, Thomas Michael Rebar, 44, of 914 Arthur Ave., Roscoe, was sentenced to five years in the county intermediate program on a charge of driving under the influence of alcohol, second offense in 10 years.
Rebar was arrested by state police on April 16 on Interstate 79. Motorists called police about Rebar’s erratic driving and followed him on the highway with emergency lights flashing to warn other drivers.
Rebar had a blood-alcohol content of 0.279 percent. He pleaded guilty Oct. 15 to DUI and three summary violations.
As part of the sentence, Rebar must serve nine months of house arrest with a GPS and alcohol monitoring bracelet, followed by three additional months of alcohol monitoring by bracelet. After the nine months of house arrest, he will be eligible for work release.
Rebar was also ordered to perform 225 hours of community service and pay $2,575
Brandon Lee Varous, 21, of 711 Seventh St., Trafford, was entered into the Accelerated Rehabilitative Disposition program Wednesday on a charge of driving under the influence of alcohol and a controlled substance, possession of drug paraphernalia and six summary violations.
Varous was arrested Feb. 25, after his vehicle struck another vehicle on I-79 in Whiteley Township. Varous had a BAC of 0.149 percent; blood tests also indicated he was under the influence of marijuaua. A marijuana grinder was found in his possession.
Varous’s driving license will be suspended for 90 days. He also must pay a $200 fine.
Those who successfully complete the ARD program can petition the court to have their criminal records expunged.
