Ten admitted to ARD program in Greene

WAYNESBURG – Several criminal defendants were admitted to the Accelerated Rehabilitative Disposition program Tuesday.

Those accepted into the program must serve at least one year probation and pay all fines and costs.

Defendants who enter the program charged with driving under the influence of alcohol also may have their driving privileges suspended and be required to refrain from the use or possession of alcohol.

Those who successfully complete the program can petition the court to have their criminal records expunged.

Admitted were:

Jennifer Miller, 30, of 165 Ruane Road, Uniontown, charged with driving under the influence of alcohol, DUI incapable of safe driving and two summary traffic violations; Miller was arrested June 16 in the parking lot of the Sheetz store in Carmichaels after police saw her cross the fog line on Route 21 multiple times. Miller’s BAC was 0.198 percent. Her driver’s license was suspended for 60 days.

David R. Falkenstein, 22, of 309 Durst Dr., N.W., Warren, Ohio, charged with driving under the influence of alcohol, DUI incapable of safe driving, and two summary traffic violations; Falkenstein was arrested June 30 after police responded to a one vehicle accident in Monongahela Township. Falkenstein’s vehicle failed to negotiate a turn on Route 2014, knocked over a fire hydrant, struck a guardrail and came to rest facing west in the east bound lane of traffic. His BAC was 0.09 percent. He was ordered to pay restitution to PennDOT in the amount of $277.17 and the Dunkard Valley Water Authority in the amount of $4,085. As a special condition of his ARD sentence, Falkenstein will be removed from the ARD program in six months if he has paid all of the costs, fees, fines and restitution by that time. Falkenstein’s driver’s license was suspended for 60 days.

Christopher John Shaw, 43, of 10 Step St., Millsboro, charged with driving under the influence of alcohol and one summary traffic violation; Shaw was arrested on May 3, 2012, after striking a guard rail and rolling his vehicle on Route 88 in Carmichaels Borough. His BAC was 0.242 percent. Shaw’s driver’s license was suspended for 60 days.

Stefan G. Chaussard, 24, of 652 Millers Run Road, Cuddy, charged with driving under the influence of alcohol and driving under the influence of alcohol incapable of safe driving; Chaussard was arrested Sept. 15 after he struck the bumper of another vehicle in Waynesburg Borough. His BAC was 0.087 percent.

Melissa Sue Ballard, 22, of 302 S. Washington St., Apt. 2, Waynesburg, charged with driving under the influence of alcohol and one summary traffic violation; Ballard was arrested June 2 in Franklin Township with a BAC of 0.154 percent. She was stopped on Route 21 with an inoperable passenger side headlight and an expired registration sticker. Her driver’s license was suspended for 30 days.

Belinda D. Nehls, 51, of 220 Edenborn Road, McClellandtown, charged with driving under the influence of alcohol and one summary traffic violation; Nehls was arrested April 27 in Cumberland Township with a BAC of 0.104 percent. She was stopped at the Sheetz parking lot after police saw her cross the center line multiple times on Route 21. Her driver’s license was suspended for 30 days.

Dea Dawn Huggins, 48, of Dunkard Terrace Mobile Home Park, Dilliner, charged with accidents involving damage to attended vehicles and two summary traffic violations; Huggins was arrested Aug. 29 after leaving the scene of an accident at 104 W. High and Morris Streets in Waynesburg. Police said a witness told them Huggins ran a red light and struck a vehicle driven by Douglas Maynard.

Leigh Ann Inghram, 24, of 116 Orchard Road, Waynesburg, charged with driving under the influence of alcohol and two summary traffic violations; Inghram was arrested Aug. 4 with a BAC of 0.122 percent. Police said Inghram failed to signal or brake while making an abrupt turn into the Belko Foods parking lot in Waynesburg Borough. They followed her to N. Richhill St. where she was pulled over. Inghram was driving with an expired Utah registration.

Megan Lynn Martin, 26, of 1271 South Muddy Branch Creek Road, Carmichaels, charged with possession of a controlled substance, possession of drug paraphernalia and disorderly conduct; Martin was arrested following an incident Jan. 18, 2013, in Cumberland Township. Police were called to the parking lot of the Brodak’s Shop-n-Save store for a possible drug overdose. Martin was in the passenger seat of a truck operated by Todd Varesko. Police said Varesko had a hypodermic needle sticking out of his finger when they arrived. Martin told EMS Southwest personnel she had used four bags of heroin and given two others to Varesko. Police said Varesko was found to be in possession of two stamp bags of heroin at the scene. Varesko is charged with possession of a controlled substance, possession of drug paraphernalia,and tampering with or fabricating physical evidence. A charge of conspiracy for possession of a controlled substance was withdrawn. Varesko pleaded not guilty on Feb. 5. Jury selection for his trial is slated for April 22.

Rose Mary Galloway 48, of 211 Liberty St., Carmichaels, charged with unsworn falsifications to authorities; Galloway attempted to purchase a rifle at the Dry Tavern Tru Value Hardware Store on Nov. 29, 2012. While filling out the gun purchase application Galloway indicated she had never been declared incompetent or involuntarily committed to a mental institution causing the form to be rejected by the Pennsylvania Instant Quick Check System.
