Lana Roe retrial to continue

WAYNESBURG- After nearly six hours of deliberations the jury of nine women and three men impaneled in the Greene County homicide retrial of Lana Kay Roe, 41, broke for the evening without reaching a consensus.

Roe was charged with her husband, Jason William Roe, 35, in the Aug. 14, 2012 shooting death of Cordele Edward Patterson, 38, in a Wayne Township hunting cabin. A jury convicted her husband of first degree murder in November, but was unable to reach a verdict regarding his wife.

The jury for Lana Roe’s retrial asked only two questions during Thursday’s deliberations.

The first was a request to see a videotape taken the day after the shooting of Lana Roe walking investigators through the scene of the shooting.

The second question referred to why a taped interview with Lana Roe, recorded at the Waynesburg police barracks 10 days after the shooting, was not entered into evidence. This interview was discussed while lead investigator Cpl. Jeremy Barni testified before the court Wednesday.

Judge William Nalitz told the jury this piece of evidence could have been entered into the record by either Assistant District Attorney Linda Chambers or Roe’s defense attorney Mike Bigley, but neither chose to do so. When Chambers initially mentioned the recording during the trial, she referenced its length as between 2 and 2 ½ hours.

Lana Roe is also charged with giving false reports to officers in about weapons allegedly stolen during a burglary at the Roe residence and falsely implicating another in the alleged burglary, namely Patterson.

At 5 p.m. the jury was brought into the courtroom by Nalitz to inquire if they wanted to break for the evening and resume their talks in the morning. The jury foreman said this was the request of the 12-member panel.

The court will reconvene in the matter at 9 a.m. today.
