Bid to toss evidence in Pa. car wash murder denied
EBENSBURG (AP) – A judge has denied a defense bid to toss out evidence in the trial of a man charged in the stabbing death of his estranged girlfriend at a Western Pennsylvania car wash.
Twenty-one-year-old Demetrius Gibson of Johnstown is charged in the Aug. 6 slaying of 21-year-old Elizabeth Ann Miller in the parking lot of the Dollar Car Wash in Johnstown’s Moxham neighborhood.
The Tribune-Democrat of Johnstown reports that the defense challenged evidence obtained in searches of an apartment and a vehicle as well as DNA samples, a photo identification lineup and electronic tracing.
The judge did order all DNA evidence as well as a video surveillance tape turned over to the defense. He hasn’t ruled on a request to move the trial or choose a jury from another area.
