Charges filed agains Megan’s Law violator

WAYNESBURG – Charges were filed Monday against a Holbrook woman who was convicted nine years ago of making a pornographic video involving an underage girl and who failed to report her residence as required under Megan’s law.

Heidi Marie Harbarger, 39, whose last known address was 378 Hoges Run Road, was charged by state police with failure to comply with registration of sexual offenders requirement.

According to the criminal complaint, police said they were contacted Thursday by the state police Megan’s Law unit who reported Harbarger had failed to appear for her required quarterly registration.

Police said they went to her last registered address and was informed Harbarger had left the resident in August. As of Monday, Harbarger has failed to notify police of her current address or appear for her quarterly verification, the complaint said.

Harbarger’s current address is unknown, police said. A warrant has been issued for her arrest and anyone with information on her whereabouts is asked to contact state police in Waynesburg.

Harbarger was found guilty by a Greene County jury in October 2005 of two counts of sexual abuse of children and one count of corruption of a minor.

In January 2006, she was sentenced to 18 to 36 months in prison. Because of the nature of the offense, Harbarger is classified as a Tier 3 offender, requiring lifetime registration.

Harbarger was originally charged after her ex-husband, William H. Rutan, sent videos Harbarger had made to Greene County Children and Youth Services in October 2004.

One tape showed a girl in a bedroom who removes her clothing before the camera and then puts on lingerie. A woman, identified as Harbarger, puts makeup on the child and asks her questions regarding kissing.

The two tickle each other on the bed. The girl then takes off the lingerie and puts on her regular clothing. The girl was 15 years old at the time of trial.

Rutan told police Harbarger gave him the tapes because she was afraid someone might turn her in for having obscene material. He said he stored the videos in his garage. Later, when he went through the videos, Rutan claims he discovered the child pornography tape and sent it to CYS.
