Bentleyville man found guilty of rape

A Bentleyville man accused of raping a young boy over a two-year period was found guilty Thursday by a Washington County jury.

Anthony Capodieci, 72, of 6 Liberty Street, was found guilty on eight counts including rape, statutory sexual assault, involuntary deviate sexual intercourse, indecent assault and corruption of minors.

The boy, who was 12 when the assaults began in June 2010, said he met Capodieci while working with him in the Eighty Four area. The boy told police that they became friends and started spending time together, particularly at Capodieci’s home.

The boy, now 15, claimed that Capodieci started by holding hands and trying to kiss him before having him engage in sex acts. The incidents occurred between June 2010 and December 2012, and occurred as frequently as twice a month.

State police said Capodieci confessed to having a sexual relationship with the boy. Capodieci’s attorney, Rose Semple, noted police made no recording of their interrogation of Capodieci or the statement he gave them.

Both the boy and Capodieci testified during the two-day trial before Common Pleas Judge John F. DiSalle. The jury reached its verdict after about one hour of deliberation.

Semple declined to comment when contacted Friday.

A sentencing date has not yet been set. Capodieci, who was free on a $50,000 bond, was taken to the Washington County jail. DiSalle ordered that Capodieci undergo an evaluation by the sexual offenders assessment board to determined he if meet the criteria of being a sexually violent predator.

Capodieci also faces charges that he intimidated the victim, Deputy District Attorney Traci McDonald Kemp said. He has not appeared before the court on this matter.
