Local man pleads no contest to indecent assault

WAYNESBURG – A Waynesburg man accused of sexually assaulting a 19-year-old woman in November 2014 pleaded no contest Friday before Greene County President Judge Farley Toothman.

Carl Mason Warnick, 35, of 554 Stone Hill Road, entered the no contest plea to charges of indecent assault, indecent assault without consent, harassment and disorderly conduct. By pleading no contest, Warnick denies guilt but admits facts stated in the indictment. Charges of aggravated indecent assault without consent and aggravated indecent assault by forcible compulsion were withdrawn as part of the plea agreement.

Police said the woman contacted them after Warnick inappropriately touched her Nov. 5, 2014, at her house. The woman told police Warnick threatened to kill her if she told anyone, according to court documents.

The disorderly conduct charge stems from an incident the same day. Police said when police told Warnick he was under arrest for assaulting the woman, Warnick took a knife from his pocket and attempted to cut himself. The knife was taken from Warnick and he was placed under arrest.

Warnick will be sentenced after being evaluated to determine if, under Megan’s Law, he is required to register as a sexual offender. However, the judge’s order states Warnick’s plea offer calls for a sentence of 5 years of probation and will include a special condition that Warnick have no contact with the victim during his sentence.
