FirstEnergy settles residents’ lawsuit over slurry dump

HOOKSTOWN (AP) – Federal court records show FirstEnergy Corp. settled a lawsuit filed by residents who claim a coal-waste dump along the Pennsylvania-West Virginia border was leaking pollutants into the ground, dampening their yards and causing housing foundations to shift.

The Beaver County Times said the documents filed Monday don’t set forth settlement terms. An attorney for the residents, Kevin Madonna, and FirstEnergy spokeswoman Stephanie Walton, confirmed the settlement but said details are confidential.

Walton said FirstEnergy settled even though the company “does not agree with the claims made in the litigation.”

The unlined dump received waste from the Bruce Mansfield power plant in Shippingport, Beaver County, since 1974. The state Department of Environmental protection ordered the dump must be covered by the year 2028, after FirstEnergy stops pumping the waste to it.Information from: Beaver County Times, http://www.timesonline.com/
