Shopper cleared in mall shooting

DAYTON, Ohio – A prosecutor concluded a shopper who fatally shot a 16-year-old boy who held him up outside an Ohio mall days before Christmas acted in self-defense.

Montgomery County prosecutor Mat Heck Jr. said the man was cleared of felony criminal charges. The prosecutor also said a 17-year-old boy was released because of insufficient evidence.

Miami Township police said three boys accosted two shoppers leaving the Dayton Mall after buying limited-edition Nike Air Jordan sneakers Dec. 20. Police said one teen showed a gun and was shot by a shopper who had a concealed-weapons permit.

The other two boys were held in juvenile detention on charges including murder.

The prosecutor’s office said Friday no decision was made on the case of the 16-year-old still held.
