WAYNESBURG – A Waynesburg woman who sexually assaulted a 15-year-old boy two years ago was sentenced Wednesday by Greene County President Judge Farley Toothman to 8 to 16 years in prison.

Tracy L. Kennedy, 48, was found guilty by a Greene County jury in March of involuntary deviate sexual intercourse, statutory sexual assault and indecent sexual assault.

In addition to the prison sentence, Kennedy will be required to register for the remainder of her life as a sex offender under Megan’s Law.

Kennedy sexually assaulted the boy on Oct. 28, 2013, when the boy and his girlfriend came to Kennedy’s house to visit with Kennedy’s 13-year-old daughter.

During the two-day trial, the boy testified Kennedy asked him to follow her alone into another room, where she sexually assaulted him. The boy said he didn’t know what to do and just froze.

When he left the room, he went to his girlfriend and told her they had to leave, he said. A DNA test proved Kennedy had sexual contact with the boy, a state police forensic DNA expert testified.

Kennedy also took the stand. She admitted giving multiple accounts of what transpired when she was questioned by Waynesburg Borough police about the incident with the boy.

She initially said nothing happened and later claimed she was the victim. Eventually, she changed her story and said what took place between her and the boy was consensual. Kennedy also said she believed the boy was of legal age.

Kennedy’s attorney, David Russo, described Kennedy as a lonely woman who had not been in a relationship for more than a decade. He said she may have misunderstood the boy’s friendliness as something more.

District Attorney Marjorie Fox said, however, Kennedy was supposed to be the adult in this situation. Kennedy should have been supervising her daughter and her friends in a parental role, she said. It was up to Kennedy to determine the boy’s age.
