Defense wants testimony in pregnant girl’s shooting tossed

PITTSBURGH (AP) – A defense attorney is asking a judge to throw out testimony by a 15-year-old witness in the shooting of a pregnant friend before he was ambushed and killed.

The Pittsburgh Tribune-Review reports that the defense attorney argued Friday in Allegheny County Court that it would be unfair to use the testimony of 15-year-old Leroy Powell of Duquesne in the May 2014 shooting of the girl, who was 31 weeks pregnant.

Attorney W. Christopher Conrad represents a teenager charged with attempted murder in that shooting. He argues that Powell can’t be cross-examined about inconsistencies between what he told police and what he said in court before he was killed in August 2014, a week after he testified.

Prosecutors said the defendant’s previous attorney had a chance to question Powell.
