Statutory sex assault charge dismissed against Perry Township man

A statutory sex assault charge has been dismissed against a 20-year-old man accused of having sex with a teen girl during a party at his Perry Township residence April 1.

The charge against Levi James Daly of 388 Big Shannon Run Road, Mt. Morris, was dismissed Tuesday during his preliminary hearing before Senior District Judge Jesse Cramer. Daly was held for court on one felony charge of corruption of minors.

Daly was 19 in April when state police said he had a party at his house. Police said the 15-year-old girl had been drinking alcohol at the party, before she and Daly went into his bedroom and had sex.

According to court documents, Daly told investigators the girl told him she was 17 and that “he thought he was set up.”

Daly remains free on $10,000 bond while he awaits his formal arraignment on July 10.
