Woman waives newborn-in-trash case to Westmoreland County Court

A Vandergrift woman who is charged with giving birth to a baby in a convenience store restroom in the Mon Valley last year and placing the newborn in a trash receptacle waived her case Monday to Westmoreland County Court.

Brittany Conway, 25, passed up a preliminary hearing in the case by agreeing to move it from the office of District Judge Charles Christner to the higher court, online records indicate.

North Belle Vernon police charged Conway last month with reckless endangerment and endangering the welfare of children stemming from the Sept. 24 incident at a 7-Eleven just off Interstate 70.

Police and emergency medical personnel were called to the store because of a report a woman suffered a miscarriage in the restroom, and they reportedly found two women who were upset and cleaning up blood. One of the women, Kimberly Conway, told an officer her daughter, Brittany, was having a miscarriage, police stated in the affidavit supporting the criminal charges.

According to the affidavit, a paramedic heard a baby whimpering in a trash can in the restroom and found a fully developed newborn wrapped in a tan plastic bag in the bottom of the garbage can, with its umbilical cord and placenta still attached.

It is not known who has custody of the baby.

Conway remains free on unsecured bond.
