Court cases
A number of criminal defendants pleaded guilty last week before Greene County Court Judge Lou Dayich.
Christine Elaine Turoliveri, 32, of Ontario, Ohio; offenses – forgery, theft, receiving stolen property; on Jan. 11, 2017, Turoliveri altered and cashed a stolen check written for the First Church of the Nazarene; sentence – 30 days to 1 year in jail, credit for time served, $350 in restitution.
Victor H. Chalen-Garcia, 28, of Woodside, N.Y.; offense – criminal mischief; on Nov. 25, Chalen-Garcia used a marker or gray paint to make a design on a sign at the front of Hardee’s Restaurant in Franklin Township; sentence – $100 fine.
Patricia Marie Lopez, 23, of 179 Hague Lane, Uniontown; offense – driving under the influence of alcohol, accidents involving damage to an attended vehicle, three summary violations; on Oct. 20, Lopez’s vehicle rear ended a vehicle on Route 21; she left the scene without providing information and crashed into a guardrail farther west on the road; her blood-alcohol content level was 0.254 percent; sentence – following preparation of a pre-sentence report.
Theodore Eugene Gibbs, 26, of 233 Presock Road, Greensboro; offenses – resisting arrest, simple assault; Gibbs ran away Jan. 27 when police attempted to arrest him on a warrant; on Feb. 11, he assaulted another inmate at the Greene County jail; sentence – 28 days to 1 year in jail, credit for time served; he was released to West Virginia which had a detainer for his arrest on other charges.
William Smearcheck, 61, of 72 Foch Circle, Nemacolin; offenses – two separate counts of DUI, third or subsequent offense in 10 years; three summary traffic violations; arrested June 21, Smearcheck had a BAC level of 0.211 percent; arrested Aug. 14, following a single-vehicle crash, he had a BAC of 0.297 percent; sentence – 2 to 10 years in prison, deemed eligible for the Recidivism Risk Reduction Incentive program which will reduce his minimum to 18 months; $5,075 in fines.
Chasidy Stoneking,38, of 109 Jollytown Road, New Freeport; offenses – DUI, controlled substance; a summary traffic violation; a blood test indicated she was under the influence of amphetamines when arrested April 25, 2017; sentence – 72 hours to six months in jail, $1,025 in fines, 60 hours of community service.
Todd E. Sibert, 44, of 104 Second St., Vestaburg; offenses – DUI, second offense in 10 years, three summary violations; arrested June 1, he refused a BAC test; sentence – 5 days to 6 months in jail, credit for time served; $1,575 in fines; 50 hours of community service.
John Michael Wunder, 24, of 77 N. East St., Waynesburg; offenses – DUI, controlled substance; two summary violations; on Oct. 28, following a two-vehicle crash in Waynesburg, Wunder was under the influence of Clonazepam, Alprazolam and cocaine; sentence – 72 hours to 6 months in jail, credit for time served, $1,225 in fines, 50 hours of community service.
Travis Grady, 37, of 1 High Ave., Masontown; offenses – DUI, controlled substance; possession of a controlled substance, possession of drug paraphernalia, providing false identification; arrested Oct. 30, 2016, Grady was under the influence of heroin and in possession of empty stamp bags and a marijuana cigarette; sentence – 72 hours to 1 year in jail, $1,300 in fines; 60 hours of community service.
Kristine Marie Seeholzer, 29, of 1012 Toms Run Road, Holbrook; offense – retail theft; on Aug. 18, Seeholzer stole clothing from Hidden Treasures in Franklin Township; sentence – 3 years of probation.
Bethany Kaitlyn Headlee, 23, of 125 Creek Road, Carmichaels; offense – possession of drug paraphernalia; after her boyfriend overdosed on heroin in her home Sept. 12, 2016, police found pipes with marijuana residue, spoons with Suboxone residue and needles; sentence – 6 months of probation, $100 fine, 30 hours of community service,
Scott Alexander Rolf, 26, of Uniontown; offense – retail theft, on Dec. 5, Rolf stole two packages of cookies at Muhly’s Store in Clarksville; sentence – 10 days of time served to 6 months in jail; restitution, 40 hours of community service.
Daniel W. Hall, 26, of 174 E. Elm St., Waynesburg; offense -possession of drug paraphernalia; arrested Nov. 3, after being found unresponsive on the sidewalk in Waynesburg, Hall was in possession of syringes and a spoon; sentence – 18 days of time served to 2 years; 20 hours of community service.
Pleading guilty earlier this month before Dayich were:
Rodney Allen Earnest, 30, of 1240 Route 88 North, Clarksville; offenses – DUI, six summary traffic violations; arrested Oct. 26, following a single-vehicle crash on Route 19 in Washington Township, Earnest had a blood-alcohol content level of 0.215 percent; sentence – 3 to 6 months in jail, $1,300 in fines.
Tonya Michelle Lee Palmer, 29, of Clarksville; offense – possession of drug paraphernalia; Palmer was found in possession of a syringe during a traffic stop Dec. 12 in Franklin Township; sentence – 7 days of time served to 1 year in jail.
In another matter before the court, Alexandra Jarrell, 21, of 412 Fourth Ave., Crucible, who was found guilty by a jury on Oct. 18 of arson, risking catastrophe, corruption of minors and other charges, was sentenced April 13 by Dayich to 3 to 6 years in prison and given credit for 38 days served; Jarrell and Jesse Jenkins, 24, of Carmichaels set fire to a mattress Sept. 20, 2015 in the abandoned Crucible school; two juveniles also were present. Jarrell failed to appear for her trial and was later arrested in West Virginia; Jenkins earlier pleaded guilty to charges related to the crime and received 15 months to 10 years in prison.
