Simpkins threatened to kill her, and Miller said she grabbed her things and began to get out of the truck, police said. Simpkins grabbed her cell phone and started to drive away quickly, but Miller was still partially in the truck and had to climb back in to avoid falling, according to the criminal complaint.
WAYNESBURG
Indecent assault charge: Cody Dean Cumberledge, 22, of 1347 Jollytown Road, New Freeport, was charged July 31 with indecent assault, harassment, two counts of DUI and six summary driving citations after an incident July 29 on West High Street. A woman approached four Waynesburg Borough police officers and said that an intoxicated man had slapped her on the buttocks and one of the other two men with him grabbed her arm. She pointed officers to the man, later identified as Cumberledge, who was seen staggering to a car on West High Street. He then got into a vehicle and began driving away without headlights on, police said. When taken to the police station, Cumberledge’s breath test showed a blood-alcohol level of 0.184, more than twice the legal limit to operate a motor vehicle in Pennsylvania.
Fleeing from accident alleged: James Woodrow Hayes, 43, of 905 S. Sherman Ave., Waynesburg, was charged Monday with leaving the scene of an accident with property damage and four summary driving violations for his alleged involvement in a March 21 crash in Waynesburg. Borough police said Hayes was driving north on Montgomery Avenue and hit another vehicle as the driver was attempting to turn left onto Montgomery Avenue from High Street. Hayes reportedly walked away from the accident, but a witness identified him, police said.
