Mother of pedestrian files suit against driver, township over fatal accident
A 24-year-old pedestrian who was struck by a van a year and a half ago along Candor Road in Robinson Township and died the next day is the subject of a suit filed this week in Washington County Court.
Nancy Kutz, the mother of the pedestrian, Alexandra Marie Tusa, and the administrator of her daughter’s estate, filed suit against both Robinson Township and the driver of the vehicle, identified as Elizabeth Bebo, who is in her 40s, of Atlasburg.
Tusa was thrown into a ditch near midday June 11, 2016, and suffered, among other injuries, a fractured skull. She was taken by helicopter to a Pittsburgh hospital, where she died the next day.
The suit called Tusa’s route along Candor and Beech Hollow roads “a commonly-used footpath.” Bebo, whose name was not released at the time, was driving north as Tusa was walking in the same direction two to three miles from Tusa’s Sunset Drive home.
Kutz claimed, at the time of the crash causing her daughter’s death, the area had 3- to 4-foot-tall vegetation obstructing the view of both motorists and pedestrians.
Robinson Township failed to trim the growth, creating a dangerous condition, alleged Kutz, who is seeking a jury trial to obtain medical, funeral and estate expenses, money for loss of her daughter’s earnings and compensation for pain and suffering.
The suit was filed by attorney Bryan S. Neiderhiser of Indiana.
