South Carolina man wanted on sex assault charges in Cumberland
A South Carolina man is wanted on charges he forced a 13-year-old to have sex with him several times at her home in Carmichaels.
Cumberland Township police filed an arrest warrant March 7 against James Patrick Biller, 23, of North Charleston, who had not been arrested as of Thursday.
Township police received a referral from ChildLine last April. The 16-year girl spoke to police in May and told them Biller was a family friend and the assaults took place three years earlier when she was 13. She told police she did not immediately report the incidents because she was afraid of Biller.
The assaults allegedly took place from October 2013 to January 2014, the victim told police. Biller allegedly forced the victim into sexual intercourse once in October, then again four or five times over a five-day period in January. She said the two were involved in some sort of relationship at the time.
Biller, she said, would come over to her home and her mother was typically also home at the time and would allow the two to be alone in another room, according to the criminal complaint.
A North Charleston police department detective interviewed Biller in October. Biller at first denied the allegations, but later told police the two had engaged in a sexual relationship, according to court documents. He later said the interactions were consensual and they took place at the victim’s home while her parents were home.
Biller told police the victim’s family was “crazy” and the victim “stalked” him, according to court documents.
“Biller reportedly disclosed to detectives that he would never have sex with (the victim) because it was wrong because she was a minor,” the criminal complaint states. “Biller did state that he had sex with (the victim), but did not have sex with her for five straight days and did not force her to have sex with him.”
The Observer-Reporter does not name accusers of sexual assaults.
Biller faces 11 charges related to the alleged offenses, including involuntary deviate sexual intercourse of a person less than 16 years old, indecent assault, and three counts each of statutory sexual assault, aggravated indecent assault and indecent exposure.
