Greene County man accused of sexually assaulting teen girl in 2013
A Greene County man was arrested Wednesday and charged with forcing a teenage girl to have sex with him more than five years ago at his Cumberland Township mobile home.
The state attorney general’s office charged James Alan Smith after investigators said he admitted to the June 2013 assault of the 16-year-old girl.
Smith, who is now 27 and lives at 296 Garards Fort Road, Garards Fort, was arraigned by District Judge Lee Watson on felony charges of involuntary deviate sexual intercourse and sexual assault, along with misdemeanor charges of corruption of a minor and indecent assault.
Investigators said Smith was 21 when he allegedly made the girl perform sex acts on him before forcing her to have intercourse at his Route 21 Mobile Home Park residence. The girl told investigators that she repeatedly told him no and to stop but he continued. Police said Smith knew the girl and her family at the time of the incident.
The girl and her mother reported the assault to Cumberland Township police a month later, initiating an investigation. Smith repeatedly denied the allegations, and continued to do so when the attorney general’s office became involved and interviewed him in February 2017.
When Special Agent Regis Kelly asked if Smith also sent the girl photos of his genitals, he denied that as well. However, investigators said they found lewd photos of Smith on the girl’s cellphone, prompting him to admit to sending photos of himself, according to court documents.
Smith then “went on to change his story about the night of the incident” and allegedly admitted to having sex with the girl, claiming it was consensual, investigators said. He told investigators that he “may have had to encourage her” and “may have held her down on the couch” during the incident, according to court documents.
No lawyer was listed for Smith on court documents. He is free on $50,000 cash bond while he awaits his preliminary hearing before Watson at 11:45 a.m. Nov. 14.
