Man pleads guilty in Waynesburg drug robbery
WAYNESBURG – A Waynesburg man charged in connection with a robbery that was motivated by drugs and resulted in the victim being shot in the leg pleaded guilty Wednesday before Greene County Judge Lou Dayich and was sentenced to 5 to 10 years in prison.
Kody Alan Scott, 22, of 206 S. Washington St., pleaded guilty to multiple counts including robbery, conspiracy theft and harassment.
Scott and Cody D. Jannenga, 21, of Piney Flats, Tenn., were charged following the March 26 robbery at an apartment at 53 S. Morris St. in Waynesburg. The two men had gone to the apartment of Johnathan C. Fannon to rob Fannon and his fiancée, Brandi Stump, of Subutex.
According to police, Fannon and Stump and their 16-month-old daughter had just arrived home about 10 p.m. when the two men knocked on their door.
Stump answered the door, and Jannenga barged in holding a silver gun, Fannon said while testifying at Scott’s preliminary hearing in April. Fannon said he put his daughter in a closet in another room to protect her, before he confronted the men.
Fannon said he grabbed the fake weapon Scott was holding and they tussled in the hallway before Jannenga fired one shot into his leg. Fannon said he grabbed the barrel of Jannenga’s gun and the three men fell down the stairs.
One of the men then repeatedly punched Fannon in the head with brass knuckles. Fannon said he eventually told the men he had “had enough” and asked them what they wanted. They said they wanted his “stuff,” referring to Fannon’s prescription of Subutex.
The men knew Fannon had the substance, with Stump having sold Subutex to Jannenga in the past, Fannon said.
Scott also pleaded guilty Wednesday to charges of contraband and possession of a controlled substance. Scott had been found in possession of Suboxone Aug. 18 at the Greene County jail.
Dayich sentenced him to 2 to 4 years on those charges, but made that sentence concurrent to the robbery sentence.
Jannenga pleaded guilty in August to robbery, aggravated assault, conspiracy theft and harassment and was sentenced to 6 ½ to 15 years in prison. A charge of attempted homicide against Jannenga was dismissed as part of a plea agreement.
