A man is accused of raping a mentally disabled woman Tuesday afternoon while they were parked at a cemetery near his Monongahela Township home.

State police charged Derrick Lee Barber, 37, of 122 Duquesne St. after troopers said the woman told her friend that he forced her to have sex in his pickup truck while they were at Monongahela Hill Cemetery near Mapletown.

Investigators said Barber and the woman had been riding around in his truck drinking beer earlier in the day when then stopped at the cemetery on Stoney Hill Road at Route 88 in Monongahela Township about 2 p.m. Police said she agreed to perform sex acts on him, but stopped when they both had to urinate, which they did outside the truck.

Barber then asked the woman “do you want this” and she responded “not really” before he allegedly began to assault her, according to court documents. She told him to stop, but he continued.

Barber took the woman back to her home, where she told a friend about the encounter, police said. She was taken to WHS-Greene hospital near Waynesburg to be treated for injuries she suffered from the alleged assault.

State police Trooper David Bell said the woman “appeared to be of diminished mental capacity” when he interviewed her about the incident at the hospital.

Barber was arraigned Wednesday by District Judge David Balint and released from the Greene County jail on $75,000 cash bond. His preliminary hearing before Balint is scheduled for Feb. 12 at 1:15 p.m. Barber could not be reached for comment Thursday and no lawyer was listed for him in online court documents.
