Unemployment appeals can still be filed even if appeal time has expired

The commonwealth’s Department of Labor and Industry is advising Pennsylvanians who have been denied unemployment benefits that they can still file an appeal even if the time of appeal has expired.

Due to the historic number of claims that have been filed over the last seven weeks, the department experienced some mailing delays involving some personal identification numbers (PINs). As a result, some claimants and their employers may have received their notice of determination letters near the end of a listed appeal period after it had already expired.

“We want everyone impacted by this delay to know they may still file an appeal if they believe the denial was incorrect,” said Jerry Oleksiak, the secretary of the labor and industry department.

When the department makes a determination on unemployment claims, the claimant and their employer are both sent a copy of that decision. Those decisions are final unless an appeal is filed in a timely fashion.

All appeals are now taking place by phone due to the coronavirus pandemic.
