Dunkard Township man sentenced to jail for sexually assaulting preteen girl

A Greene County man who pleaded guilty earlier this year to sexually assaulting a 12-year-old girl and possessing child pornography was sentenced to jail this week.

Brian Allen Carey, who is now 21, was sentenced Tuesday by President Judge Lou Dayich in Greene County Court of Common Pleas to serve 2 to 5 years in the county jail as part of his negotiated plea with the state Attorney General’s office.

Carey pleaded guilty Feb. 13 to two felony counts each of statutory sex assault and indecent assault of a person younger than 13, along with felony charges of child pornography and corruption of minors.

Carey and another man, Richard Herman Carey, 23, both of whom resided on Bunner Hill Road in Dunkard Township, were arrested by state police in February 2023 after the social media company Snapchat notified authorities that child pornography had been uploaded to an account in early 2022. Police did not specify how the two men are related.

Police said they found child pornography on Richard Carey’s cellphone, while another phone belonging to Brian Carey contained a video of him sexually assaulting a 12-year-old. Brian Carey, who was 18 at the time of the assaults, allegedly confessed to police that he had committed multiple sex acts with the victim, according to court documents.

Richard Carey pleaded guilty June 12 to two felony counts of child pornography along with felony charges of disseminating film of child sex acts and criminal use of a communication facility. Dayich is scheduled to sentence him Aug. 27 at 2 p.m.

Brian Carey was originally facing numerous additional charges, including rape, but those were not prosecuted in exchange for his plea. After Tuesday’s hearing, Brian Carey was taken by sheriff’s deputies to the Greene County jail, where he’ll serve the remainder of his sentence. He has been jailed on $150,000 bond since his arrest in February 2023, so he’ll be given credit for time served.

When Carey is released from jail, he will be placed on probation for three years and must complete 100 hours of community service. He must also register on the Megan’s Law sexual offender list for the rest of his life. His defense attorney, Herbert Terrell, did not respond to a phone message seeking comment.
